Yes, it is possible to sign a rental agreement remotely under the 2026 Digital India framework, using Aadhaar-based e-signatures. Guardia ensures you remain compliant with the Andhra Pradesh and Telangana tenancy laws. It also does Aadhaar verification and then wraps up the agreement wherever you are, no need to travel in India. This is legally binding and the whole process remains fully remote.

Background checks and Aadhaar-based verification are conducted before shortlisting tenants. You retain final approval. If you already have a tenant, we verify and manage them from day one.
If you own a property in India but reside overseas, your tenant must deduct 31.2% TDS on the rent under Section 195. This comes up as a normal approach across Hyderabad, Bangalore, and most other places. But that 31.2% is basically an advanced style holding amount, not the whole or final tax. When you later submit your Indian income tax return, the actual tax gets worked out based on your situation. If the tenant deducted more than what you actually owe, then the excess is typically returned to you as a refund. So your final responsibility depends on your eligible deductions, the tax regime you select, and your total income earned in India. In practice, most NRIs pay less than that initial TDS figure.

As per Section 195, when a tenant pays rent to an NRI landlord, they are generally supposed to deduct TDS at 31.2% from the rent amount before it is actually paid. That said, this is kind of a provisional or on account deduction. Later, after you file your Indian income tax return, if the TDS that was deducted is more than your real tax liability, the extra portion is refunded back to your NRO account. Guardia's tax team then checks the picture via Form 26AS, prepares your filing and also assists in getting the refund you're eligible for.

Yes, you can request a Lower Deduction Certificate (LDC) under Section 197 by filing Form 13 with the Income Tax Department. After approval, your tenant may deduct TDS at a lower rate, based on your estimated actual tax liability instead of the usual 31.2% benchmark. In practice this helps monthly cash flow a bit, and it usually lowers the size of the refund you'd otherwise be asking for later via your ITR filing. Usually, no, not if your country has a Double Taxation Avoidance Agreement with India, and most do. As of 2026, the US, UK, UAE, Canada, and Australia are all covered under DTAA. So you pay tax on the rental income in India, then when you file in your country of residence you claim that amount as a Foreign Tax Credit, more or less. Guardia basically connects you with NRI tax specialists, who take care of the forms and steps so you don't end up paying more than you should.

Yes, and it is almost always in your favour. TDS at 31.2% is a flat withholding. Your actual liability after deductions, such as municipal taxes and the standard 30% on Net Annual Value, is usually lower. Filing ITR-2 is the only way to claim that refund. You must file if your total Indian income exceeds ₹2.5 lakh. Guardia's tax team handles it end-to-end so you don't leave money on the table.

This is a fair question and many NRIs have asked this. The announcement of Budget 2025 was impossible to miss: zero income tax up to ₹12 lakh under the new regime. Sounds like it should apply to all, but it doesn't. NRIs are subject to the same slab rates as resident individuals, but they do not get the benefit of the rebate under Section 87A. So, tax is payable from the first rupee of taxable income - even if it is below ₹12 lakh. What NRIs get is the higher basic exemption limit of ₹4 lakh under the new tax regime. Otherwise, normal slab rates apply, with no rebate to reduce the bill.
So if your rental income is ₹6 lakh, a resident Indian pays zero. As an NRI, you pay tax on everything above ₹4 lakh.
That said, DTAA provisions, standard deduction on rental income, and municipal tax deductions can still reduce what you actually owe. Guardia's tax team makes sure you are using every deduction available to you.

You need an NRO account to receive rent, sale proceeds, or any income earned in India. An NRE account is only for foreign income you bring into India and is fully repatriable. Rent from your property must go into your NRO account first. After taxes and paperwork, you can repatriate up to USD 1 million per year abroad.

You sign a Power of Attorney then your representatives will be accompanied by us at the Sub-Registrar's office. It depends on your property's document readiness, market conditions, asking price and buyer availability. We audit your ownership records, identify gaps, and obtain a formal legal opinion from empanelled lawyers. To avoid delays, make sure that you have all the documents, including the title deed, encumbrance certificate, PAN card, and tax records. After we get everything and your property is sales-ready, our verified local channel partners start looking for the buyers. Most properties settle in 3 - 6 months if there is no legal complication.
The documents you need to provide are your title deed, property tax receipts, Aadhaar or passport, PAN card, existing encumbrance certificate and OCI card if applicable and a Power of Attorney is required if you are not physically present. For financial compliance you need Forms 15CA and 15CB are mandatory for remittances exceeding ₹5 lakhs, and Form IPI-7 must be submitted to the RBI within 90 days of the transaction. If you do not have all of these ready, tell us what you have, and we will guide you through what is needed and how to get it sorted remotely. Missing documents are not grounds for delaying the process. A Lower Deduction Certificate (LDC) can reduce TDS deducted by the buyer under Section 195 of the Income Tax Act. When your property is sold you won't receive the money directly. FEMA rules says sale proceeds first need to be deposited in your NRO account in India. From there, you can repatriate up to USD 1 million per financial year provided your taxes are clear. Guardia coordinates this with an authorized dealer bank, deals with capital gains tax through a resident CA and applies for a Lower Deduction Certificate to bring down the TDS your buyer deducts upfront. At the end you get a formal closure certificate. All the money is accounted for, legally transferred and documented.
Yes and this is where most NRI sales go wrong without the right help. Before your property even hits the market, Guardia's empanelled lawyers audit every document, flag what is missing and get it resolved. Nothing goes to a market until the opinion is clean. Registration at the Sub-Registrar is by way of a Power of Attorney, where someone authorised signs on your behalf so you never need to fly in. More than you'd imagine, this happens, and it's manageable. A tenant can't stop a valid sale, but they need to be managed properly. Guardia issues a formal notice under Section 106 of the Transfer of Property Act 1882, giving the tenant a definite legal period to vacate. If they refuse, Guardia files for eviction in the local courts in Telangana or Andhra Pradesh. Notices, filings, hearings, the whole bit. Before any buyer ever sees the property, the team comes in with cleaning, staging and photography when the property is empty. You never get involved in the conflict at all.

Yeah. As an NRI, you have the legal right to sell inherited residential or commercial property in India. Tax treatment is similar to selling property you purchased yourself. If your property is a long term capital asset (held for more than 24 months including the previous owner's period of ownership), then LTCG tax rate is 12.5% + surcharge + cess. The buyer can deduct TDS at an effective rate of around 13% to 14.95% depending on the transaction value and applicable surcharge. When calculating capital gains on property inherited, the original owner's acquisition cost and holding period of the property are considered.

It depends on how long the property has been held. Properties held for over 24 months are known as Long-Term Capital Assets, which now attract Long-Term Capital Gains (LTCG) tax of 12.5% without indexation due to amendments in the Finance Act 2024. If you sell the property within 24 months from the date of purchase, it is considered a Short Term Capital Asset and the gains from such a sale are taxed as per your income slab. The buyer is also required to deduct TDS before making payment and when you file your Indian income tax return it is adjusted.
When an NRI sells property in India, the buyer must deduct TDS under Section 195 before making payment. For long-term capital gains transactions, the effective TDS rate is generally between 13% and 14.95%, depending on the surcharge and cess applicable to the transaction value. For short-term capital gains, TDS may be significantly higher because the gains are taxed at applicable slab rates. In many cases, NRIs apply for a Lower Deduction Certificate under Section 197 so that TDS is deducted based on the actual estimated tax liability instead of the full default rate.

Yes, there are 3 ways to do it. First, under Section 54, you sell a residential property, reinvest the capital gains into another residential property within 2 years, and pay zero tax. Section 54F applies when you sell land or commercial property and reinvest the full sale proceeds into a residential house within 2 years. If you still have access to the mobile number registered with your Aadhaar you may be able to update it using the official mAadhaar app, subject to UIDAI's eligibility requirements. Unique Identification Authority of India (UIDAI) website, has recently introduced a face-authentication feature on the official mAadhaar mobile app which allows eligible users to request a phone number update online and if the phone number linked is not available then the only options is to be physically visit an Aadhaar Seva Kendra or authorised Aadhaar enrolment/update centre. Your identity will be verified using biometric authentication before the new mobile number is updated.
For PAN, you can update your contact details by logging into the Income Tax e-Filing portal. If your PAN records need to be updated, you can submit a PAN correction request through the relevant PAN service provider, Protean (formerly NSDL) or UTIITSL.

Yes. If your Aadhaar-linked mobile number is active and you can complete the required authentication, you can submit an address-update request through myAadhaar from abroad. You’ll also need to provide a valid proof-of-address document.
Yes. NRIs can provide an international or non-Indian mobile number in their Aadhaar details. However, SMS messages are not delivered to international mobile numbers, so an overseas number may not work in exactly the same way as an Indian number for every Aadhaar service.
