Section 195: Tax is calculated on capital gain for filing. But actual buyer TDS is on full sale value at applicable rates.
Exemptions: Sections 54, 54F, 54EC are indicative only. Not considered for buyer TDS deduction.
Section 54F Formula: Capital Gain × (Investment / Net Sale Consideration) - Legal formula applied.
Surcharge Cap: For LTCG on property, surcharge is capped at 15% (not 37%).
Section 197: Lower TDS rate may be available with a certificate from the Income Tax Department.
NRI TDS: Buyers deduct TDS under Section 195 on the full sale consideration unless lower withholding documentation (CA certificate or Section 197 certificate) is obtained.
Capital Loss: Even with a capital loss, buyers must deduct TDS on full sale value without proper documentation.
STCG Buyer TDS: For STCG, buyers typically deduct TDS at 30% by default, regardless of the seller's actual slab rate.
CA Certificate: Form 15CB from CA certifies lower TDS and allows deduction based on actual tax liability (no double cess).
AO Certificate: Assessing Officer can issue certificate for lower TDS under Section 197. Takes priority over Section 197.
Certificate Priority: AO Certificate > Section 197 > Standard Rate. Only one applies.
CA Certificate & Cess: tdsOnGain already includes cess, so no additional cess is added.
